The procedural history of the MAI scheme

 

MAI manufactures computers. It also provides the designs. The MAI scheme implements the software that can run on the computers it manufactures. The software is generally licensed to the customers for their own internal information processing. The MAI licenses allow for the loading of the software into the RAM by the MAI customers. Finally, The MAI gives servicing to the hardware and software for its machines. Peak Computer which was organized by a former MAI employee, is an independent service organization performs for maintaining the computer systems for its clients. Peak's clients include the customers of MAI's computer systems. The MAI scheme has the copyright interests in software as it designs and implements by including the operating system software that is needed to run the other programs on the computer. The MAI's operating system software is actually designed to give load automatically from the hard disk into the computer's RAM every moment that the computer is turned on. The Servicing procedure of the computer whether it is done by Peak service technicians or others, usually requires the computer to be turned on. Hence, the automatic loading feature of the operating system into the RAM takes place.

 

Important factors ignored by MAI

 

The Ninth circuits suggest that Peak was guilty of copyright infringement cases and is problematic also as it resulted in the MAI using its copyright interests in its software so the usage of the computer can be controlled. By inhibiting Peak's uses of the computer, The MAI effectively extended its copyright monopoly. It was done by reserving an exclusive right to perform servicing the hardware on which the software can runs. This kind of result generally defeats the purpose of the copyright law which is meant to protect an author's interest in the work that is copyrighted.
