Copyright – an overview

Registration of the copyright in India provides economical rights to the creators of their materials that include art, music, literature, sound recordings, films, broadcasts. Copyrights also provide moral rights to be recognized as the creator of those materials. These are subjected to object to its distortion. The copyright does not protect the names or titles or any ideas. The copyright act allows the registrants to earn the economic rewards for the efforts they have done towards it and to encourage and inspire future creativity and also develop materials. This protection is automatic after the recording in the form of material that is created.

 

 

 

What is the concept of copyright?

 

Copyrights are subjected to the ownership of the works including the fields of literacy, artistic or cinematographic works like poems, songs, novels, presentations, computer programs, paintings, choreography, sculptures, architectures, dramatic scripts, etc. These works after being copyrighted assure to be original and the author’s self-creation.

 

How does copyright work?

Copyright is a form of intellectual property. Copyrights give protection to the expression of ideas, not the ideas. It exists in a work as soon as the author finishes the work. Initially, the author is the owner of the copyright. If an employee creates the work, that employee will be considered as the author and that employee owns the copyright as the work for hire. Being the owner of the copyright the author has exclusive rights to create copies of the work, then display and perform that work publically to distribute it.

 

There are two conditions to be qualified for having the protection of copyright-

 

  • It has to be created independently by the author not being copied from others.

  • It should have a minimal degree of creativity.

 

Basic requirements of the work that needs the protection of copyright

 

The following requirements are needed for a work to be protected by copyright-

  • There should be an expression of ideas involved in the field of literary, dramatic, artistic works, audiovisual matters, etc.

  • The created work has to the original.

  • The work should be recorded in the form of material.

  • There should have an author or artist.
