The Micro, Small and Medium enterprises development Act or MSMED Act, 2006 was introduced on October 2, 2006. What is the MSMED ACT, 2006?

 

Micro, Small, and Medium Enterprises (MSME) sector is a very dynamic and revolutionary sector of the Indian Economy. It performs a major function in the development of the economy of India and has risen as a developing industrial area that provides various opportunities in employment issues, industrialization, and the creation of new businesses. The Micro, Small and Medium enterprises development Act or MSMED Act, 2006 was introduced on October 2, 2006.    

 

Benefits of the revised criteria as per the MSMED Act,2006

 

The economy has undergone significant changes since the criteria have been revised-

  • It will be revised upward as the announced revision is still not in the line with the market and price conditions.
  • The limits for the medium enterprises can be further increased as the PM of India Narendra Modi has said.
  • The MSMEs contribute about 29 percent to India’s gross domestic products. It comprises almost half of its exportation. This unit has employed over eleven million workers.

Purpose

 

A single widespread act for the development and regulating process of small enterprises had been an outstanding demand of the Sector. so to free it from an abundance of the laws and regulations and the visit of inspectors, which it had to turn with limited awareness and resources. The requirements have been emphasized from time to time by the stakeholders. Additionally, some recommendations to provide for a proper legal framework for the small sector to soothe it of the needs to comply with various rules and regulations which were made by the Committees such as the Committee of Abid Hussain (1997) and Study Group that was under Dr. S.P. Gupta (2000). As the small industries continued to be very important for the Indian economy. In recent years the small scale services have also flourished as an important sector that contributes enough to the national economy by employing millions of workers. Hence, it has become very necessary to address both the small scale industries and services together and recognize them as small enterprises as it is practiced worldwide as a composite sector. In a rapidly developing economy, like India's natural mobility of the small enterprises to the medium ones has to be emphasized through proper policy interventions and legal framework. Keeping these objectives in mind, the Government turned out with the exclusive legislation for the micro, small and medium enterprises or MSMEs known as the Micro, Small, and Medium Enterprises Development Act (MSMED Act ), 2006.

Type of enterprises fall under MSMED Act

 

There are two divisions of micro, small, and medium enterprises or MSME mentioned below-

 

(1) Manufacturing Enterprises

(2) Service Enterprises

 

A brief discussion about the above-mentioned enterprises-

 

  • Manufacturing Enterprises:

 

 All about the commercial enterprises is like any business that enforces the use of the components, elements, and raw materials to form a final product. The final products are sold directly to the clients or to different manufacturing agencies that use them for making one kind of thing.· There are many products under manufacturing enterprises such as as- Printing, cigarette manufacturing, Ayurvedic products, and other tobacco products, etc.

 

  •  Service Enterprises:

 

Some firms are engaged in conveying or rendering of the offerings and are defined in the form of phrases of investment in the equipment. Many products are under service enterprises such as Publishing, Hospitals, Restaurants, Education, Training, Software services, etc.

 

Process of filling the application under the MSMED ACT,2006

 

The Government has introduced an online delayed payment controlling system where an afflicted party can file an application that is known as the MSME Samadhan. A supplier must file a memorandum with the State Government or the Central Government. Any MSME applicant who has a valid Udyog Aadhar Memorandum (UAM) can easily file an application related to the delayed payment in the MSME Samadhan. After the submission is over, the application is automatically forwarded to the related Facilitation Council or center MSEFC. After that, the MSEFC shall examine the matter and send the requisite notice to the buyer for the clearance of the pending amount.

 

Persons who can file a complaint under the MSMED Act

 

An Individual or an Entity who is registered as Micro or Small Enterprises under the MSME Act and who has Udyog Aadhar Certificate can easily file a case with the MSE Facilitation Council.

 

What are the protections do an enterprise gets from the MSMED ACT, 2006?

 

According to the MSMED Act 2006, If any buyer has purchased any good or availed any service from a Micro, small and medium enterprises or MSME which has filed the UAM, at that situation the buyer shall do the payments on or before the agreed date that has been done the buyer and supplier in writing. If the period between the buyer and the seller is already agreed then the period shall not exceed more than 45 days from the date of delivery of that certain goods or rendering the wanted services.
