TRUST REGISTRATION PROCEDURE:

  • Trust
  • Society

Trust Registration:

A Trust can be made by the performance of a trust deed; there are two types of trust. Public trust is created for the opportunity of the general public and a private trust created for the opportunity of an individual group of separates known as the beneficiary. Various states in India have different Trust Acts which govern the trust. Another way of registering an NGO is on the farm of Trust. Trust is a separate legal entity. Trust Deed is the first requirement in the procedure of trust registration.

Trust starts with the drafting of a trust deed, the first step to register The trust deed is to be formed on applicable non-judicial stamp paper, the rate of stamp duty differs from state to state, and assignation with the sub-registrar office and the government registration fee is to be paid after that.

On the appointed date all trustees need to be present along with two witnesses. The registration process is then handover by the office of the sub-registrar, and the registered deed can be collected after a week time. Then, to get the PAN and TAN Number for the trust and open a Bank account for the trust.

Documents Required for Trust Registration:

  1. Signature Trust Deed by trusted and settler.
  2. Stamp paper in the name of Trust. Stamp paper & Notarization shall be prepared by us.
  3. One photocopy of the address proof & ID proof of Trustee and Settler required. (voter I.D./Driving license/ passport)
  4. Presence of settler at the time of registration with his/her original I.D.
  5. Presence of two witnesses at the time of registration with original I.D. proof.
  6. NOC from Landlord.
  7. One photograph of Each of Trustee and Settler.

Income Tax Formalities:

An important step is Trust Registration to follow for 12A and 80G certificate from the Income Tax Department. A Trust achieves such a certificate is released to pay income tax for the whole lifetime on its surplus income.

NGO must earn 80G certificate. NGOs or other non-profits must apply for registration and income tax department before being granted such a certification.
