SOCIETY REGISTRATION:

The Society Registration Act, 1860 was the British Rule in India. These laws and regulation regarding the procedure for the registration of societies in India. Sometimes society is registered. It should be a legal entity. The societies are registered mainly for the intention of charitable activities like arts, education, religion, music, sports, etc. This is considered as one of the more charitable acts with respect to registration requirements of NPO and accounting and auditing regulations. Society registration act becomes a very important piece of law, and this society can perform very important rules in the country. The Societies Registration Act, 1860 which came into force on 21 May 1860. Society can be made by a group of seven or more people. The person from India, foreigners and companies can also register for the Memorandum of Association of the society. At the first time, the members must agree with the name of society first and ready for the Memorandum then followed by rules and regulations of the society. This is a regulation in India which allows the registration and benefit of society education, health, employment etc. Society registration is maintained by state governments. Society registration created to the particular authority of the state, where the registered office of the society is established.

Some features of society as follows:

  • A society can be created by a minimum of seven or more than seven persons.
  • Many other people from India, companies, foreigners also register for the Memorandum of society.
  • Finally, society is registered, it should legal existence and only registered society can be legally protected and can scope of an advantage given by the government.

An object of Society Registration:

A society registration can be done for the improvement of fine science, arts or literature for attachment of purposeful learning or charitable purposes of political education. According to society registration can be done for the following purposes:

  • Development of science, arts and literature.
  • Creation and development of orphan funds.
  • Funding for charitable supports.
  • Diffusion of political education.
  • Collections of inborn history.
  • Foundation and protection public museum.
  • Maintenance of libraries and reading rooms.
  • Collections of mechanical and philosophical inventions, instruments, and designs.

Society Registration process:

1. Selection of Unique Name:

This is the basic step for the basement of a society. Select the right name for your society. When choosing the name of your society, you must be careful this act does not permit the use of similar to the names of other societies those are already into existence.

2. Memorandum of Association Rules and Regulation:

MOA must have the official stamps and the complete address of the witnesses. It also must include a table the name, addresses and professions of all the members of the society. The members of General body along with their signatures should be included in the Memorandum of Association.

3. Documents Required for society Registration:

  • Original ID Proof, such as Aadhar card, Pan card etc. of all the members.
  • Address proof of all the members.
  • Memorandum of Association(MOA)
  • Articles of Association(AOA)
  • Copy of Property Papers.
  • A non-objection letter signed by landowner.
  • Electricity bill or Water bill.

4. Submission of Documents and Registration:

The applicant must be filed two copies of MOA with the Rules, and Regulations document to the register of the society. Registrar signs the first copy as acknowledgement and returns it to the applicant after receiving the application, and the second copy for approval. If the Register is satisfied with the terms, and conditions of your organization and the documents filed, he would certify to regard the society to be registered.
