Samples

 

The business samples are essentially specimens of products which will be foreign by the traders or Representatives of makers Abroad in India, to understand its characteristics and usage and to assess its marketability within the country. Samples include goods, durables, prototypes of an engineering product or perhaps high-value instrumentation, machinery (including agricultural machinery) and their accessories. However, product that is prohibited under Foreign Trade (Development and Regulation) Act, 1992 don't seem to be allowed to be imported as samples e.g. wild animals, wild birds and components of wild animals and birds, ivory, arms & ammunition, and Narcotic drugs.

 

Who will import samples?

 

Samples will be imported by the trade, industry, people, Companies, Associations, Research Institutes or Laboratories. These also can be brought by the Representatives of foreign Manufacturer as a part of their personal Baggage or through a port or in courier. They can even be sent by Manufacturers/Traders abroad to the above parties in India.

 

Value limit for import

 

The bonafide trade samples will be foreign by Trade and trade provided the aforesaid products are equipped freed from charge. For duty-free clearance the worth of individual sample shouldn't exceed Rs.5000/- and combination price shouldn't exceed Rs. 60,000/- annually or fifteen units of samples during a year. However, the Prototypes of engineering product will be foreign even if the worth is more than Rs.5000/-. Such a prototype product will be imported up to a worth of Rs. 10,000/- while not payment of duty as long because the product is rendered useless as merchandise by a suitable method. just in case the worth exceeds Rs. 10,000/-, the aforesaid product need to be re-exported among a period of 9 months or such extended amount because the Assistant Commissioner of Customs could permit. The high valued samples are cleared once depositing duty with Customs and giving an undertaking for his or her re-export within 9 months. The deposited duty is refunded once the machinery is exported back. However, if more than one product is being foreign into India, the worth limit is increased proportionately. Similarly, if the samples are consigned to quite one receiver, by any foreign company, and are sent at an identical time through identical Port/Airport, it shall not be charged to duty if the worth limit of Rs.5000/- per unit is adhered to. The consignments meant for distribution to totally different parties in India also can be imported along for the convenience of transport, if the packets are clearly marked and addressed to totally different persons in India.

 

The value of Rs.5000/- is that the price of the products at a country of dispatch excluding local refundable taxes like VAT within the country of dispatch. Just in case of free samples of Rs.5000/-, it doesn't embrace freight or traveller charges. If the worth is higher than Rs.5000/-, the freight and insurance charges would be further to calculate the duty due.

 

Machinery import

 

Machinery, that is prototypes of an engineering product, imported either for more producing of the aforesaid product or to be used as the capital product for export production or in the association of securing more export orders also can be imported duty-free if the worth doesn't exceed Rs.10000/-. The products will be cleared by furnishing a Bank Guarantee (or) deposit of the duty due and an enterprise from the importer that the aforesaid goods would be re-exported among nine months of import. Just in case of high valued machinery, the importer has given an enterprise that the aforesaid product is used for the aim of an illustration at the place (s) that is said. The Customs authority may seal the machinery throughout its journey from the Port of importation to the place of demonstration and it's unsealed only at the place of operation or place of demonstration.

 

Failure to re-export

 

The samples need to be re-exported among nine months. However, the Assistant Commissioner, Customs, could below special circumstances extend the amount of nine months for an additional affordable period.

 

Import of samples under another scheme

 

In addition to higher than the subsequent specific provisions/ schemes are on the market for nontaxable import of samples;

 

(a) Under 100 per cent EOUs, EPZ, EHTP Schemes the samples of every type of products factory-made by the Units will be imported duty-free.

 

(b) The sample also can be foreign for the government of India sponsored events viz. Trade and industry fairs. This machinery is imported under a Carnet (Notification No.57/90).

 

(c) Samples also can be imported for personal business exhibition for show or demonstration with the prior permission of the Ministry of Commerce and Indian Trade Promotion Organization, (Notification No.3/89).

 

(d) Samples are allowed nontaxable import for promotion of commercial enterprise instrumentation and adjuvant product. (Notification No.113/57)
